SUBJECT: NOTICE FOR DEFICIENCY IN SERVICE AND UNFAIR TRADE PRACTICE REGARDING ORDER #[ORDER-ID]
Sir/Madam,
Under instructions from my client, [Seller Name], carrying on business at [Seller Address], I hereby serve you with the following legal notice:
1. That my client entrusted a shipment vide AWB No. [TRACKING-NO] on [Date] through your logistics network. The said shipment contained goods valued at INR [VALUE].
2. That despite proper packaging and handover, the status of the shipment was falsely marked as "Customer Refused Delivery" (Fake RTO) without any genuine attempt to deliver the said consignment to the consignee.
3. That such an act of marking a false status amounts to "Deficiency in Service" as defined under Section 2(11) of the Consumer Protection Act, 2019, causing severe financial loss and mental agony to my client.
4. That you are hereby called upon to compensate my client with the sum of INR [VALUE] along with interest @ 18% p.a. within 7 (seven) days from the receipt of this notice, failing which my client shall be constrained to initiate appropriate legal proceedings against you in the Consumer Disputes Redressal Commission.
